1/ INTRODUCTION

All transport operations and all other rendered services performed by Les Montgolfières du Sud are regulated by: applicable fees, general terms and conditions below and applicable regulations entirely part of the present conditions.

 

2/ TARIFS

Our prices are valid as from January 1st 2014 and include 10% VAT for free flights and 20% VAT for captive flights. They can be changed without notice. Our rates include: organisation of the ascent (crew, assistance vehicle, transport), passenger transport insurance against payment. Our tickets are non refundable.

 

3/ TICKET PURCHASE

Tickets are nominative and valid for a period of 12 months as from issue dates. They will be sent to you by return mail as soon as we receive the booking form, duly completed and the deposit check according to the flight. The payment can be fulfilled by debit card on our Website. No ticket can be given or name changed without the transporter’s agreement.

 

4/ BOOKING & FILGHT CONFIRMATION

 

4.1 BOOKING

The client will contact Les Montgolfières du Sud to choose (subject to availability)
the date of his flight. Our tickets are valid for 12 months as from issue date. During that period of time, you must have tried minimum 4 times, confirmed by our booking centre, otherwise your ticket will automatically expire. If those attempts have been unsuccessful due to weather conditions, you ticket will be extended for one yearn free of charge. If you have made less than 4 attempts during the year, you will have the possibility of extending your tickets by paying the 80€ extension charges. Any ticket older than two years will automatically expire. NB: the flying season begins in April and ends end of October.

 

4.2 FLIGHT CONFIRMATION

The day before the flight, between 18h30 and 19h30, the passenger must phone the company to confirm the flight. If the flight can’t happen, it will be pushed back to another date chosen by mutual agreement.

 

5/ CANCELLATION OR RESCHEDULING by the Montgolfières du Sud

Montgolfières du Sud reserves the right to cancel the flight due to bad weather conditions for safety reasons or due to insufficient number of passengers. The day of the flight only the pilots are qualified to appreciate the relevance of the flight. The cancellation can happen on take off site; in which case, Montgolfières du Sud will not be held responsible for any fees incurred by the clients to come to the meeting point. (Travelling, accommodation, restaurants). In any case, the ticket is valid until the end of the validity period and another date will be agreed on by mutual agreement.

 

6/ CANCELLATION OR RESCHEDULING BY A PASSENGER

 

6.1 RESCHEDULING

In the case of rescheduling on your behalf, please warn us minimum 72 hours before the flight.

 

6.2 LATE RESCHEDULING OR NO SHOW

6.2.1 In the case of late rescheduling (less than 72 hours before the flight) or no show on the day and time of the meeting point, the ticket will be considered as used and the deposit will not be returned.

6.2.2 PFor groups, the 30% deposit will be entirely returned to the client if the cancellation occurs 30 days before the flight, minus the 180 Euros incl VAT management fees. If the cancellation occurs between 15 and 30 days before the flight, only 50% of the deposit will be returned. The deposit will definitely remain in the hands of Montgolfières du Sud if the cancellation happens within 15 days before the flight.

 

7/ PHYSICAL AND MEDICAL CONDITIONS

In-air activity is a « risk environment » that the pilots try to minimize thanks to their experience, their professionalism and the material means used. But it is clear that they cannot guaranty 100% security particularly due to the objective risks of the activity, particularly when landing.

The passengers must be able to climb in and out of the basket, stand during the flight and hold on to the security handles when landing complying with safety measures given by the captain.

We are not qualified to judge the physical condition of a passenger for a flight in a hot air balloon. If you suffer from a medical problem, if you have just undergone a surgery operation or in case of doubt regarding you fitness to fly in a balloon, please consult a doctor and warn Montgolfières du Sud

We are sorry not to be able to take on board pregnant women and children aged under 6.

 

8/ FLIGHT CONDITIONS

The captain reserves the right to change the meeting time and take off site, the flight duration.

Flying in a hot air balloon is entirely dependent on weather conditions and aerology of the day, Les Montgolfières du Sud do not guaranty the circuit or the route. The average flight duration is of one hour. However, the captain can interrupt the flight for legal or security reasons. No flight will be reimbursed if the flight lasted a minimum of 30 minutes.

 

9/ RULES ONBAORD OUR HOT AIR BALLOONS

All passengers must appear on boarding list. He will arrive on time at the rendezvous dressed in suitable clothes (non-flammable clothes covering arms and legs, walking or sports shoes, cap).

He will follow the safety instructions given by the captain or crew, on the ground and while flying. The captain is the only authority on-board and on this basis, has authority on the persons embarked. He can choose not take on board or disembark any one or load representing a danger for the execution or the security of the flight.

 

10/ SUBCONTRACTING

Montgolfières du Sud reserve the right to call on a subcontractor to carry out the flight. The French Civil Aviation approves all our partners.

 

11/ INSURANCES

Montgolfières du Sud are insured as air carrier; the passengers are insured for General Liability within the limits required by Warsaw Convention governing air transport (114 500€/passenger in 2014).

Our insurance companies do not take objects taken on board by the passengers into account. It is your responsibility to take out an additional insurance if you consider it necessary.

 

12/ LIGITATION

Any ligitation, claim, settlement failure of any nature regarding our flights shall be referred to the Court of Nîmes, except for the cases subject to the rules relating to jurisdiction of public order.

 

13/ ACCEPTANCE OF THESE TERMS

All order implies the entire acceptance of these terms.
